"Do I have a case?" This is how most initial telephone calls end. I often thought I should write a book on some of the more interesting fact patterns where people have wondered if they have a case. I've had people ask me if they can sue a raccoon for causing them to fall or if they can sue the government for the secret messages they were being sent through the radio waves. In both instances--they did not have a case.
But a bad perm causing 2nd degree burns? Falling on the rough of a golf course causing a trimalleolar fracture? Dropped glass resulting in tendon surgical repair? These are all cases I did take and achieved a successful result for my clients. The most important question to ask if you have a case is if there was another party that was negligent, or careless, which resulted in you getting injured significantly.
